Terms and Conditions

To the extent you use Airfone® Service ("Service"), you agree to be bound by all the terms and conditions set forth below:

About the Service.
The Service is provided by Verizon Airfone. The Service provides the ability to make air-to-ground telephone calls on subscribed General Aviation aircraft during flights over the contiguous 48 states. To use this service, you must utitlize an accepted credit card. The Service is not available in all areas. Limitations on calling apply. A description of all Airfone Services, applicable charges and other important information is provided on this site.

Charges and Payment.
Charges for the Service, airtime charges and applicable taxes and surcharges, will be billed on your credit card or through pre-arranged monthly billing.

Waivers and Limitations of Liability.
Unless the law forbids it in any particular case, you agree to limit claims for damages or other monetary relief against Verizon Airfone, to the aggregate amount billed to you for the Service. This limitation and waiver will apply regardless of the theory of liability, including, but not limited to, fraud, misrepresentation, breach of contract, personal injury or products liability, and it means you will not seek any indirect, special, consequential, treble or punitive damages from Verizon Airfone.

Changes.
The Service is subject to the business policies, practices and procedures of Verizon Airfone and those policies, practices and procedures can be changed at any time without notice. These terms and conditions and the charges assessed for the Service also can be changed at any time by Verizon Airfone. To the extent you use the Service after the changes goes into effect, you accept the changes. 

Disclaimer of Warranties.
Verizon Airfone makes no representations or warranties, express or implied, about the Service regarding any implied warranty of merchantability or fitness for a particular purpose. Verizon Airfone cannot and does not promise that the Service will be uninterrupted or error-free.

Dispute Resolution.
Instead of suing in court, you agree to settle disputes involving the Service, except for certain small claims matters, only by arbitration. The Federal Arbitration Act applies to these terms and conditions. Any controversy or claim arising out of or relating to these terms and conditions, or any prior agreement between the parties or any affiliates or predecessors in interest, will be settled by one or more neutral arbitrators on an individual basis before the American Arbitration Association. This does not change your substantive rights, just the forums for resolving disputes. You can still bring any issues you may have to the attention of appropriate federal, state or local government agencies.
