In the event that Verizon has no space available for physical collocation, the CLEC will be allowed to construct or otherwise procure adjacent structures, e.g., controlled environment vaults (CEV), or similar structures where technically feasible as provided by Verizon approved vendors. Verizon will recover all costs incurred by Verizon associated with the CLEC's deployment of an adjacent structure on a case by case basis.

The CLEC is responsible for complying with any zoning requirements, state or local regulations, and for obtaining any associated permits. Verizon may, where required, participate in the zoning approval and permit acquisitions and the CLEC is responsible for expenses incurred by Verizon at the particular point in time when they occur or any ongoing expenses that may result from this action. Verizon will make available to the CLEC, power and physical collocation support services in the same non discriminatory manner as it provides to itself for Verizon's own adjacent structures.

The termination of Verizon facilities are defined in the applicable state tariffs. Any protection as it relates to fire, safety, electrical, bonding, or grounding is the responsibility of the CLEC. Verizon reserves the right to inspect the CLEC structure. All non-conformances must be remedied.

The CLEC is responsible for all necessary regeneration.

The CLEC is responsible for any fines, penalties and expenses for zoning, environmental safety, sanitation, property infringement, noise, quality of life or property violations or law suits associated with the structure and its associated power and any additional tax assessment levied on Verizon as a result of the adjacent structure.

The CLEC may not take any action in establishing an adjacent structure that will force Verizon to violate any zoning requirements or any federal, state or local regulation, ordinance or law.

Any construction by the CLEC on Verizon premises must comply with Verizon technical specifications as they relate to environmental, safety and grounding requirements as set forth in Verizon technical specifications and Telcordia Technologies documentation.

If the CLEC vacates the adjacent structure, the CLEC is responsible for restoring the land to its original condition.
